Terms of Service

The Services are for adults 18 years of age and older. By using them, you confirm that you are at least 18 and able to enter into these Terms. An adult may keep a profile for a child or another person in their care, and is responsible for that profile and for having the right to record that person’s information.

Phebe is a nutrition diary. It counts what you eat, including macros, minerals, vitamins and amino acids such as phenylalanine and tyrosine, against daily targets you choose. You can log food by search, barcode or a photo of a nutrition label, weigh portions with a Bluetooth kitchen scale, keep favorites and recipes, record height, weight and exercise, and read your steps from Apple Health or Health Connect. An account is optional; with one, your diary is backed up and the same on your phone and in the Web App.

Nutrient values are estimates drawn from food data and the portions you confirm. They are approximate and are not laboratory measurements.

Phebe provides information and lifestyle support. It is not medical advice, a medical device, or a diagnostic tool, and it does not replace your physician, dietitian, metabolic clinic, or other qualified healthcare provider. Always follow the guidance of your care team and do not change your diet, formula or treatment based solely on the Services.

You can use the App without an account. If you create one, you are responsible for keeping your login credentials secure and for activity under your account, including every profile it holds. Tell us promptly if you suspect unauthorized use. You can sign out everywhere, delete a profile, or delete the account and everything under it from Settings.

We send account email, such as verification codes, password resets and notices about your account or these Terms, to the address on your account. We send the Phebe newsletter only if you chose it, and you can stop it at any time with the link in each one or in Account.

Members with an account may opt in to the Phebe data co-op. Opting in is voluntary and separate from using the Services. If you opt in, you accept the Data Reuse Consent, which sets out what may be reused (de-identified data only), for which purposes you elect, and how to withdraw. Where these Terms and the Data Reuse Consent differ about reuse of your data, the Data Reuse Consent controls. Data read from Apple Health, Health Connect or any other vendor is never part of the co-op.

Keeping a diary earns streak rewards: a day counts when breakfast, lunch and dinner are each logged that day, and milestones are reached at intervals we publish in the App. Rewards are a loyalty program for using Phebe. They are not payment for your data, they are not earned by opting in to the co-op, and they have no cash value until we pay them.

To withdraw rewards you must be a co-op member and connect an account through Stripe, which may require identity verification. We pay rewards at our discretion and in the amounts we set; we may change, pause or end the program at any time, and we may withhold rewards where we reasonably believe entries are not genuine. You are responsible for any taxes on rewards you receive.

An account holder may ask for researcher access. We decide whether to grant it. A researcher may license de-identified datasets through the Web App under a subscription billed by Stripe and a data-use agreement presented at that time. Licensed data is de-identified; the researcher must not attempt to re-identify any person, must not share the data beyond the agreement, and must use it only for the purpose licensed. We may revoke researcher access, and end a licence, for breach.

You agree not to:

• use the Services for any unlawful purpose;
• attempt to disrupt, damage, or gain unauthorized access to the Services or to another person’s account or profile;
• create entries that are not genuine in order to earn rewards;
• attempt to re-identify any person from de-identified data;
• scrape, copy, or harvest content or data without our permission; or
• reverse engineer or interfere with the Services except as allowed by law.

The entries, notes, photos, favorites, recipes and other content you add are yours. You grant us a limited licence to store and process that content solely to operate the Services for you, and, if you opt in to the co-op, as the Data Reuse Consent describes. You can delete your content, any profile, and your account at any time.

The Services and their content, including the Phebe name, logo, text and design, are owned by Phebe Corporation and protected by applicable law. You may not use them without our prior written permission. Underlying food data comes from public sources such as the USDA and Open Food Facts under their own licences.

The Services rely on third-party providers for hosting, databases, email, AI label reading, payments and food data. We are not responsible for the content or practices of those third parties. Stripe’s terms apply to any account you connect with it. Apple Health and Health Connect are provided by Apple and Google under their terms. If you connect a Bluetooth kitchen scale, body scale or other hardware, that device is provided by its manufacturer and used at your own discretion.

If you download the App from the Apple App Store or Google Play, your use is also subject to that store’s terms. Apple and Google are not responsible for the App or for support, and they are third-party beneficiaries of these Terms with the right to enforce them against you.

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that estimates are accurate, that a reading from a scale, a label or a health platform is correct, or that the Services will be uninterrupted or error-free.

To the fullest extent permitted by law, Phebe Corporation will not be liable for any indirect, incidental, special or consequential damages arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed one hundred US dollars or the rewards paid to you in the twelve months before the claim, whichever is greater.

You agree to indemnify and hold harmless Phebe Corporation from claims arising out of your misuse of the Services, a profile you keep for another person, or your violation of these Terms, to the extent permitted by law.

You may stop using the Services and delete your account at any time. We may suspend or end your access, or your researcher access, if you violate these Terms or to protect the Services. Sections that by their nature should survive will survive termination.

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in North Carolina, and you consent to the personal jurisdiction and venue of those courts.

We may update these Terms from time to time. The effective date above reflects the latest version, and your continued use of the Services means you accept the updated Terms. If a change materially affects the co-op or rewards, we will provide notice through the Services.
